Arbitration Act 2025
2025 c. 4
Key Principle
Amends the Arbitration Act 1996. The law applicable to an arbitration agreement is the law expressly agreed by the parties or, in the absence of such agreement, the law of the seat, displacing the common-law inquiry into the law with the closest connection. Imposes disclosure duties on arbitrators as to circumstances relevant to impartiality; limits costs orders against arbitrators to cases involving bad faith; regulates resignation-related liability. Restricts applications concerning jurisdictional questions already determined by the tribunal, introduces summary awards and emergency-arbitrator procedures, reforms appeals and challenges on court powers, substantive jurisdiction, preliminary questions, costs and time limits, and repeals sections 85 to 88 concerning domestic arbitration agreements.
