Key Principle

By a 2:1 majority, the word 'person' in section 15 of the Protection from Harassment Act (allowing a person to obtain a declaration and correction order in respect of a false statement of fact) does not extend to the Government, so the Government cannot invoke section 15 against publishers of allegedly false statements.
