Balfour Beatty Construction (Scotland) Ltd v Scottish Power plc
Balfour Beatty Construction (Scotland) Ltd v Scottish Power plc 1994 SC (HL) 20; [1994] CLC 321
Key Principle
A party in breach of contract is liable only for consequential loss that was within the reasonable contemplation of the parties at the time of contracting; where the defender (an electricity supplier) had no actual or imputed knowledge of the pursuer's special need for an uninterrupted continuous concrete pour, the demolition and reconstruction loss flowing from a supply interruption was too remote and not recoverable.
