Barnes v Addy (1874) LR 9 Ch App 244
Key Principle
A stranger to a trust is not made a constructive trustee merely for acting as agent of the trustees within their powers; liability attaches only where the stranger receives and becomes chargeable with trust property (knowing receipt) or assists with knowledge in a dishonest and fraudulent design of the trustees (knowing assistance).
