Bouvier, Yves Charles Edgar v Accent Delight International Ltd
[2015] 5 SLR 558; [2015] SGCA 45
Key Principle
A Mareva (freezing) injunction requires a good arguable case on the merits and a real risk of dissipation of assets to be established on solid evidence; an allegation or even a good arguable case of dishonesty does not by itself prove a risk of dissipation unless the dishonesty alleged has a real and material bearing on the risk that assets will be dissipated.
Area of Law
Civil procedure — Mareva injunction — real risk of dissipation
