A party that brings court proceedings in breach of an arbitration agreement and unsuccessfully resists a stay will ordinarily be ordered to pay costs on an indemnity basis, by analogy with the rule applied to unsuccessful resistance to enforcement of an arbitral award (the existing 's.45 interim measures' description is incorrect: this is an indemnity-costs-on-stay case).
