Key Principle

'Corrupt conduct' within ICAC's investigative jurisdiction under s 8(2) of the Independent Commission Against Corruption Act 1988 (NSW) is limited to conduct that adversely affects, or could adversely affect, the probity of the exercise of official functions by a public official, and does not extend to conduct affecting merely the efficacy of those functions.
