Gould v Vaggelas [1985] HCA 75; (1985) 157 CLR 215
Key Principle
Where a material fraudulent misrepresentation is made which is calculated to induce a person to enter a contract and that person does enter the contract, a fair inference of fact arises that he or she was induced by the representation; the representation need not be the sole inducement and the inference may be rebutted by proof of actual knowledge of the truth or non-reliance.
