Key Principle

At the close of the prosecution case the test is whether there is some evidence (not inherently incredible) which, if accepted, would establish each essential element; the court does not at that stage evaluate credibility on the maximum, and calling on the accused to give evidence (with adverse-inference provisions) does not offend natural justice or the presumption of innocence.
