Heaven v Pender

Key Principle
Whenever one person is so placed with regard to another that anyone of ordinary sense would recognise that want of ordinary care and skill would cause danger of injury to that person or property, a duty arises to use such care and skill (Brett MR's proto-neighbour principle).
