Key Principle
A Mareva (freezing) injunction, including a worldwide Mareva injunction, may be granted or reinstated where the applicant shows a good arguable case and a real risk that the defendant will dissipate assets to frustrate enforcement; a defendant's history of dishonest conduct and of breaching disclosure obligations in related proceedings is cogent evidence of a real risk of dissipation, and an applicant who proceeds ex parte must give full and frank disclosure.
