JurisdictionHong Kong
CourtHong Kong Court of First Instance
Year2023

Key Principle

The Hong Kong court will ordinarily grant or maintain an anti-suit injunction to restrain foreign (here Russian) court proceedings brought in breach of a valid Hong Kong-seated arbitration agreement unless the defendant shows strong reason to the contrary, and a bare invocation of foreign procedural law or alleged sanctions-related access-to-justice obstacles will not displace the injunction.
