Key Principle
Where a building contract is terminated for repudiation, a builder cannot recover on a quantum meruit for work in respect of which a contractual right to payment has already accrued, and any restitutionary claim for incomplete stages is limited so that it cannot exceed the portion of the contract price attributable to that work.
