Key Principle

Even where physical damage is foreseeable, a duty of care arises only if the threefold Caparo requirements — foreseeability, proximity, and that it be fair, just and reasonable to impose the duty — are all satisfied; and it was not fair, just and reasonable to impose on a marine classification society a duty of care to cargo owners for the negligent survey of a vessel.
