Key Principle
On the proper construction of the Telecommunications Ordinance (Cap 106), the Telecommunications (Competition Provisions) Appeal Board has no discretionary power to suspend a direction of the Telecommunications Authority (here, a s.36B direction to supply unbundled local loops) pending the determination of an appeal, the statute conferring automatic suspension only in specified categories.
