The beneficial ownership of the matrimonial home is determined by the parties' actual or inferred common intention as to its ownership, ascertained through ordinary property and trust principles, not by any broad judicial discretion to do what is fair; a spouse does not acquire a beneficial interest merely by carrying out improvements.
