Key Principle
Once the presumption of knowledge under s 18(2) of the Misuse of Drugs Act is triggered, the legal burden shifts to the accused to prove on a balance of probabilities that he did not know the nature of the drug; merely raising a reasonable doubt is insufficient, and an accused's lies and material omissions in his statements may corroborate guilt.
