Public Prosecutor v Lew Syn Pau

The statutory prohibition on a company giving financial assistance for the acquisition of its own shares (s 76 Companies Act) is to be construed in light of the mischief at which it is aimed, and assistance routed through a foreign subsidiary may fall outside the prohibition.
