Key Principle

A statutory provision imposing a legal (persuasive) burden on the defendant may infringe the Article 6(2) ECHR presumption of innocence; where it does, the court may, under s.3 of the Human Rights Act 1998, read the provision down to impose only an evidential burden if a legal burden would be a disproportionate interference.
