Key Principle
A claim to adverse possession against a deceased's estate fails where the claimant cannot prove the essential elements of factual possession and an intention to possess (animus possidendi), and occupation that began and continued with the permission or licence of the estate's executors or their permittees cannot ripen into adverse possession.
