Key Principle
The Clean Water Act's 'waters of the United States' extends only to relatively permanent, standing or continuously flowing bodies of water connected to traditional interstate navigable waters, and to wetlands with a continuous surface connection to such waters making them indistinguishable from those waters; the 'significant nexus' test is rejected.
