Key Principle

Where an offender suffers from a psychiatric condition that contributed to the offence and impaired the capacity for self-control, the deterrent value of imprisonment is diminished and rehabilitation may take precedence; the court may impose a Mandatory Treatment Order where the statutory conditions are met, even in cases (such as maid abuse) where general deterrence ordinarily dominates.
