Key Principle

Where a trustee/fiduciary applies trust money to acquire property for himself, the beneficiary may elect to claim a proportionate proprietary share in the asset (and its increase in value); repayment with interest does not extinguish the claim — any profit is for the beneficiary, any loss for the trustee.
