Key Principle
To make out the tort of conspiracy (whether by unlawful means or lawful means) the plaintiff must prove a combination with an intention to injure the plaintiff and, where unlawful means are relied on, that the statutory provision breached was intended to give rise to tortious liability rather than merely to protect the public; a breach of a regulatory scheme enacted for the public benefit does not without more supply 'unlawful means'.
