A relationship other than employment can give rise to vicarious liability where it is sufficiently akin to employment, applying the five-factor test set out by Lord Phillips: ability to pay; activity undertaken on behalf of the defendant; activity integral to the defendant's business; defendant's creation of the risk; and the tortfeasor's control by the defendant.
