Key Principle

An imaging (preservation) order may be granted to capture a forensic snapshot of a departing employee's devices, securing documents and metadata as to access, copying and uploading, where there is evidence of misuse of confidential information; but the grant of an imaging order does not entitle the applicant employer to inspect the imaged material, which must be reviewed through ordinary disclosure via the respondent's solicitors.
