Key Principle

Section 127(3) of the Consumer Credit Act 1974, which renders improperly executed credit agreements unenforceable, is compatible with ECHR Protocol 1, Article 1 and Article 6 as a proportionate legislative policy to protect consumers; and Hansard can only be used as a tool of statutory construction in limited circumstances following Pepper v Hart.
