Key Principle
A libel claim may be struck out as an abuse of process where lengthy and unexplained delay in prosecuting it, coupled with non-repetition of the words, so diminishes the gravity of the alleged harm that the cost and resources of a trial would be disproportionate to any legitimate vindication to be achieved (a Jameel-type abuse).
