The merits threshold for the iniquity exception to legal professional privilege is a prima facie case: it must appear more likely than not on the balance of probabilities that the alleged iniquity exists. Provided the dominant purpose test is satisfied, litigation privilege is not confined to litigation to which the client is a party, and Three Rivers (No 5) has no application to litigation privilege.
