Key Principle

Where joint debtors are liable for a costs order, a co-debtor who discharges the whole liability is entitled at common law to a contribution of one half from the other joint debtor, and an ATE insurer that indemnified the paying debtor is subrogated to that common-law contribution right, independently of the Civil Liability (Contribution) Act 1978 which does not apply to a debt liability.
