Key Principle
In cross-border group litigation for environmental harm caused by infrastructure works, claimants suing an English-domiciled defendant must still prove that the works actually caused them recoverable loss or damage, and a claim fails where causation of damage is not established or where any liability has been extinguished (e.g. by novation).
