Ascot Commodities NV v Olam International Ltd
Ascot Commodities NV v Olam International Ltd [2001] EWHC 520 (Comm), [2002] CLC 277
Key Principle
Although arbitrators need not deal with every argument on every point, an award should deal, however concisely, with all the essential issues; deciding a central matter on a basis that does not reflect the case a party reasonably thought it was meeting, without giving an opportunity to address it, is a serious irregularity under section 68 of the Arbitration Act 1996.
