On combined applications to strike out / for reverse summary judgment and to amend a much-revised pleading with relief from sanctions, the court will assess whether the existing or amended case discloses a real prospect of success and may permit a claim to proceed on a re-revised pleading even while refusing discrete relief from sanctions, declining to strike out where a viable cause of action survives.
