Key Principle

Where a judgment debt incurred by fraud survives the debtor's bankruptcy, the court has jurisdiction under s.37(1) of the Senior Courts Act 1981 to make an order (including appointing a receiver or granting an injunction) compelling the debtor to exercise his pension rights so that drawdown sums become available to satisfy the creditors.
