Key Principle

Where the parties have compromised the substance of litigation but cannot agree costs, the court should be slow to determine costs in a way that would in effect require it to try the very action the parties intended to avoid; in many such cases the appropriate order is no order as to costs, unless it is reasonably clear from the settlement who is the successful party.
