Blackman v Man

Key Principle
Where want of testamentary capacity and want of knowledge and approval are alleged so as to put the propounder to proof, the will is nonetheless upheld if, applying Banks v Goodfellow and on the whole of the evidence, the propounder establishes that the testator had capacity and knew and approved the contents on the balance of probabilities.
