Broom v Aguilar

[2024] EWHC 1764 (Ch)
JurisdictionUnited Kingdom
CourtHigh Court of Justice, Chancery Division
Year2024
StatusPersuasive authority

Key Principle

An order permitting service of a claim form by alternative means does not validly effect service on a defendant who is out of the jurisdiction and over whom the court has no jurisdiction at the time the order is made; compliance with such an order is not good service, so any substantive order subsequently made is made without jurisdiction (following Chellaram v Chellaram).
