Key Principle

The equitable presumption against double portions applies to adeem (or pro tanto reduce) a testamentary gift where the testator, standing in loco parentis to the donee, has made a substantial lifetime gift in the nature of a portion; and such a gift may include provision made for a grandchild where in substance it relieves the parent of his obligation and is treated as coming out of the parent's share.
