Key Principle

For the purposes of postponing the limitation period under s.32 of the Limitation Act 1980, 'deliberate concealment' under s.32(1)(b) requires that the defendant withheld a fact relevant to the claimant's right of action with the intention of concealing it, and 'deliberately' in s.32(1)(b) and (2) means intentionally and does not extend to recklessness.
