Carr v Isard

[2006] EWHC 2095 (Ch)
JurisdictionUnited Kingdom
CourtHigh Court of Justice, Chancery Division (Michael Furness QC, sitting as a deputy judge)
Year2006
StatusPersuasive authority

Key Principle

The making of wills that purport to dispose of a co-owner's share in jointly owned property does not, of itself, sever a beneficial joint tenancy; severance still requires an act operating on one's own share, a mutual agreement, or a course of dealing within the principle in Williams v Hensman.
