Key Principle

In a Fatal Accidents Act claim the court may assess the dependency using the conventional percentage approach to the deceased's income, determine which family members (including adult children) were genuine dependants on the facts, and award damages for the deceased's pre-death fear and anguish where there was an appreciable interval of awareness before death.
