Collier v Williams

[2006] EWCA Civ 20; [2006] 1 WLR 1945
JurisdictionUnited Kingdom
CourtCourt of Appeal (Civil Division)
Year2006
StatusBinding authority

Key Principle

On the service of claim forms, a solicitor is only 'acting for' a defendant within CPR 6.5 (now CPR 6.7) so as to be capable of accepting service if the defendant has notified the claimant that the solicitor is instructed and authorised to accept service; and the power to extend time for service under CPR 7.6 is to be applied strictly, the rules not being a happy hunting ground for satellite litigation.
