Key Principle

Under the Working Time Directive an employer is obliged to ensure that workers are actually able to take, and do take, their minimum daily and weekly rest periods; national guidance stating that employers need only make rest possible but need not ensure it is taken renders the Directive's rights ineffective and breaches the Directive.
