Key Principle

On the proper construction of a subcontract entered into by two unincorporated joint ventures, a single constituent company of one joint venture is not itself a 'Party' and so cannot unilaterally commence statutory adjudication in its own name; an adjudicator who assumes jurisdiction on that basis acts without jurisdiction and the decision will not be enforced.
