Key Principle

Where a later settlement agreement contains an exclusive jurisdiction clause in favour of the courts that conflicts with an arbitration clause in an earlier agreement, the settlement agreement's dispute-resolution provisions will generally be construed as superseding the earlier arbitration agreement, so no stay under section 9 of the Arbitration Act 1996 is required.
