Devaseelan v Secretary of State for the Home Department
[2003] Imm AR 1
Key Principle
Where a later immigration appeal raises an issue already decided in an earlier appeal between the same parties, the first adjudicator's determination is not binding but is the authoritative and unquestioned starting point, to be departed from only for good reason such as genuinely new facts or evidence that could not earlier have been obtained.
