Key Principle
The constitutional principle of open justice gives a court an inherent jurisdiction, not exhaustively defined by the Civil Procedure Rules, to permit a non-party access to documents placed before the court and referred to at a hearing, to the extent needed to enable public scrutiny and understanding of the proceedings, subject to a proportionality balance against any countervailing interests.
