Key Principle

A late application to amend a statement of case to raise a new estoppel-based answer to a limitation defence will be refused where there is insufficient evidence to give the new case a real prospect of success, and a phone-hacking limitation period under s.32 Limitation Act 1980 begins to run once the claimant knows enough to appreciate he has a worthwhile claim, not when he learns the full extent of the wrongdoing.
