In assessing disputed factual evidence a tribunal should test oral evidence against the contemporaneous documentary record and the inherent probabilities rather than relying primarily on a witness's demeanour, which is an unreliable guide to truthfulness, and should not begin by assessing the credibility of uncorroborated recollection of events long past.
