Key Principle

Where a broker/intermediary provides valuable services in connection with a transaction at the defendant's request but no enforceable express fee agreement is proved, the court may award reasonable remuneration either under an implied contract for services or by way of a restitutionary quantum meruit, the reasonable fee being assessed objectively rather than by reference to the broker's overstated or dishonestly asserted entitlement.
